These Terms of Service (“Terms”) govern your use of the Ponderwell mobile application (“the App”), published by 3 Bit Productions LLC (“we,” “us,” or “our”), a Texas limited liability company. By downloading, installing, or using Ponderwell, you agree to be bound by these Terms. If you do not agree, do not use the App.
Ponderwell is a private journaling and mood-tracking tool designed to help users organize and engage in self-directed personal growth.
Ponderwell is not psychotherapy, counseling, medical advice, or a substitute for professional mental health care. It does not diagnose, treat, cure, or prevent any disease or condition. It does not provide therapeutic recommendations or clinical guidance. The App is a self-directed journaling and emotion-tracking tool intended to help users stay organized and engaged with their chosen self-growth activities. It does not replace the care of a licensed mental health professional.
Ponderwell is designed for individuals age 17 and older, who are engaged in self-growth activities. The App is intended to help users organize their thoughts before events, reflect on them afterward, track mood patterns over time, and maintain a private journal.
The App is not intended for use as a crisis intervention tool, a diagnostic instrument, or a clinical record system. Reports and documents generated by the App are user-created summaries based on self-reported data. They are not clinical records, medical documents, or professional assessments, and should not be treated as such without review by a qualified professional.
Use of Ponderwell does not create a therapist-client relationship, doctor-patient relationship, or any other professional relationship between you and 3 Bit Productions LLC, its principals, or any individuals involved in the development of the App. Although the App may incorporate general psychological concepts, all prompts, quotes, educational content, and other materials are provided in a generalized, non-clinical manner and are not based on any individual user’s circumstances. No licensed professional is providing services to you through the App, and the App does not provide individualized advice, diagnosis, or treatment.
You acknowledge and agree that Ponderwell does not monitor, review, analyze, or respond to any user content, including journal entries, mood check-ins, or other information entered into the App. 3 Bit Productions LLC has no obligation to review user content for accuracy, completeness, legality, safety, or any indication of distress or crisis. The App does not provide alerts, notifications, outreach, or intervention of any kind based on user activity or input. You are solely responsible for seeking appropriate professional care or emergency assistance when needed.

You should not rely on the App to identify or respond to crisis situations or urgent needs.
Ponderwell is designed so that user-generated content is stored locally on your device. This includes journal entries, mood check-ins, session responses, and other information you choose to enter into the App.
3 Bit Productions LLC does not collect, access, transmit, or store your personal content on external servers. However, the App may transmit limited, non-personal technical data (such as device information and error logs) for the purpose of diagnosing and resolving technical issues.
You are solely responsible for maintaining the security of your device and for backing up your data. Because your data is stored locally, deleting the App, losing your device, or device malfunction may result in permanent loss of your data. We do not have the ability to access, retrieve, or restore your data under any circumstances.
The App may provide features that allow you to export or share your data. Once you choose to export or share information outside the App, that information is no longer controlled by Ponderwell and may be subject to the privacy and security practices of third-party services.
You acknowledge and agree that you use the App and store information at your own risk.
Ponderwell allows you to generate and share reports, summaries, journal exports, and a “Journey Document” based on your self-reported data. These exports are:
(i) user-generated, based entirely on data you entered into the App; (ii) mechanically generated summaries of user-entered data only; (iii) not analyzed, interpreted, or validated by any professional; (iv) not clinical records, medical documents, or professional assessments; and (v) not intended for use in diagnosis, treatment, or clinical decision-making.
If you choose to share exported reports with a therapist or healthcare provider, those reports should be understood solely as personal self-reflection materials based on user-entered data. We make no representations regarding the accuracy, completeness, or usefulness of any exported content. Any clinical interpretation or use should be performed solely by a qualified professional.
The App, including its design, code, prompts, educational content, curated quotes (arrangement and selection), audio, and branding, is the property of 3 Bit Productions LLC and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works based on the App or its content without our prior written consent.
Content you create within the App (journal entries, mood data, responses, letters, homework notes) is yours. We do not claim ownership of your content.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Ponderwell on your personal device for personal, non-commercial use.
Ponderwell is available in a free tier with limited features and a paid subscription that unlocks the full App experience. Paid subscription options include monthly, annual, and lifetime plans. Pricing is displayed in the App and on the App Store (Apple) and Google Play Store listings at the time of purchase.
Subscriptions are processed through the Apple App Store or Google Play Store. By subscribing, you also agree to the payment terms of the applicable store. Monthly and annual subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your device’s App Store or Google Play Store account settings.
Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not process payments or refunds directly.
Your data remains yours regardless of subscription status. If your subscription expires or you downgrade to the free tier, you retain full access to all data you have created. You can always view, export, and back up your data. Premium features (such as reports and advanced analysis) may become unavailable until you resubscribe, but your underlying data is never locked, deleted, or held behind a paywall.
A “Restore Purchases” option is available in the App’s Settings to restore your subscription on a new device or after reinstalling the App.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant that the App will produce any particular therapeutic, emotional, or psychological outcome. We do not warrant the accuracy, completeness, or usefulness of any content, prompts, quotes, or reports within the App. We expressly disclaim any warranty that the App is suitable for use in connection with any mental health condition or that it will produce any emotional, psychological, or behavioral outcome.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 3 BIT PRODUCTIONS LLC AND ITS PRINCIPALS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THIS LIMITATION INCLUDES, WITHOUT LIMITATION, ANY CLAIMS RELATED TO EMOTIONAL DISTRESS, MENTAL HEALTH OUTCOMES, RELIANCE ON CONTENT GENERATED BY OR AVAILABLE THROUGH THE APP, OR USE OF THE APP IN PLACE OF PROFESSIONAL CARE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO US FOR THE APP (INCLUDING SUBSCRIPTION FEES) IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless 3 Bit Productions LLC and its principals, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.
We reserve the right to modify, update, or discontinue the App at any time without notice. We may also update these Terms from time to time. The most current version will be available on the App Store (Apple) and Google Play Store listings for Ponderwell. Your continued use of the App after changes to these Terms constitutes your acceptance of the revised Terms.
We may terminate or suspend your license to use the App at any time, for any reason, without notice. Upon termination, your right to use the App ceases immediately. Sections 10 through 16 of these Terms shall survive termination.
If your subscription expires or is canceled, you will revert to the free tier. You will retain access to all data you have created and the ability to export or back up that data.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and 3 Bit Productions LLC regarding your use of Ponderwell and supersede all prior agreements and understandings.

The following terms apply to your use of the App obtained through the Apple App Store:
(a) Acknowledgment. This EULA is between you and 3 Bit Productions LLC only, and not with Apple Inc. (“Apple”). 3 Bit Productions LLC, not Apple, is solely responsible for the App and its content.
(b) Scope of License. The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
(c) Maintenance and Support. 3 Bit Productions LLC is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
(d) Warranty. 3 Bit Productions LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
(e) Product Claims. 3 Bit Productions LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
(f) Intellectual Property Claims. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, 3 Bit Productions LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
(g) Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
(h) Third-Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
